UTILITÉ ET AVENIR DE MON BLOGUE DANS L’AFFAIRE COFFIN
Je pense qu’il est opportun de faire le point sur l’état de ce dossier. Il y a ceux et celles qui mettent en doute l’utilité de mon blogue et qui s’inquiètent de son avenir. Voici sommairement ce qui reste à venir dans cette affaire.
GROUPE DE RÉVISION DES CONDAMNATIONS CRIMINELLES
Rappelons-nous qu’une motion a été présentée le 25 octobre 2006 par le Bloc québécois au Comité permanent de la justice, demandant au Comité de révision des condamnations criminelles (CRCC) de voir s’il y a des motifs qui permettraient de renverser la condamnation de Coffin en 1954. Cette motion a été adoptée par le parlement canadien le 6 février 2007 :
« Attendu que plusieurs observateurs, dont l’ex-journaliste et sénateur Jacques Hébert, ont mis à jour les irrégularités qui ont entouré la mise en accusation, la condamnation et l’exécution de Wilbert Coffin.
Attendu que la sœur de Wilbert Coffin, Mary Coffin, et le fils de Coffin, Jimmy Coffin, souhaitent que le processus formel de révision judiciaire soit engagé en vertu de la partie XXI.1 du Code criminel, il est proposé :
Que, conformément à l’article 108 (2) du Règlement, le Comité permanent de la Justice et des droits de la personne recommande au gouvernement d’agir avec diligence et célérité dans le dossier de feu Wilbert Coffin et qu’il soit fait rapport à la Chambre de l’adoption de cette motion dans les plus brefs délais.

UN RAPPORT PRÉLIMINAIRE DE L’ASSOCIATION IN DEFENCE OF THE WRONGLY CONVICTED
Je vous rappelle les propos du député de Windsor-Tecumseh, Joe Comartin du Nouveau parti démocratique, intervenant dans le débat des communes, le 5 février 2007. Il affirmait ce qui suit :
« Il y a toutes sortes d’allégations très solides d’ingérence politique partisane manifeste au Québec à l’époque, à des échelons aussi élevés que ceux du premier ministre et du procureur général. La conduite du procureur dans le cadre de cette affaire est certainement suspecte, d’après ce que nous dit l’Association in Defence of the Wrongly Convicted. Le rôle joué par l’avocat de la défense et la façon dont il a été amené à prendre part au procès font également sourciller. »
Vous constatez comme moi que cette Association a déjà fait connaître son opinion en 2007. Pourquoi met-elle tant de temps à produire son rapport final?
RECOMMANDATIONS DU GROUPE DE RÉVISION DES CONDAMNATIONS CRIMINELLES
J’attends aussi le rapport du Groupe de révision des condamnations criminelles (GRCC). Le GRCC a reçu le mandat de voir s’il y avait des motifs susceptibles de permettre de renverser la condamnation de Wilbert Coffin en 1954. Le GRCC peut formuler l’une des recommandations suivantes :
a) rejeter la requête de la famille Coffin,
b) saisir une cour d’appel de cette affaire,
c) ou recommander la tenue d’un nouveau procès.
Si celui-ci en vient à la conclusion qu’il est préférable de laisser tomber cette affaire, vous avez raison, mon blogue pourra cesser ses activités. Si, au contraire, on réfère le cas à une cour de justice, mon blogue aura encore une très grande utilité pendant plusieurs mois et même plusieurs années. Le gouvernement ne semble pas avoir la même définition que moi des mots « diligence et célérité » et « dans les plus brefs délais ».
DOCUMENTAIRE SUR L’AFFAIRE COFFIN RÉALISÉ PAR GASPA
Gaspa est une maison de production de documentaires destinés à la télévision. Elle a son siège social en Gaspésie. Son réalisateur Jean Guénette travaille depuis deux ans avec deux historiens à la réalisation d’un documentaire sur l’affaire Coffin. Des informations uniques vont y figurer, m’annonce son réalisateur.

OBJECTIF ATTEINT
J’aurai atteint l’objectif que je m’étais fixé en écrivant mon ouvrage L’affaire Coffin : une supercherie? et en créant ce blogue, soit de mettre à la disposition du public toute l’information disponible sur cette affaire. Ce faisant, le public pourra juger lui-même des démarches qui seront proposées au parlement ou du jugement qui sera rendu par une cour d’appel ou de celui rendu par une cour criminelle advenant la tenue d’un nouveau procès. Comme vous pouvez le constater, mon blogue est destiné à une longue vie.
Quand j’ai commencé ma recherche dans l’affaire Coffin, j’étais convaincu qu’il s’agissait d’une erreur judiciaire. Comme plusieurs Québécois, j’avais lu les livres de Jacques Hébert.
Sachez toutefois, et je le répète, que je serais très heureux que Wilbert Coffin soit innocenté. Malheureusement, je n’ai rien vu dans les 20 000 pages et plus de textes que j’ai analysés au cours de ces trois dernières années qui puissent faire naître cet espoir. Et c’est pour cette raison que je presse notre gouvernement de mettre fin, au plus tôt, aux souffrances de la famille Coffin.
Ceux et celles qui prétendent posséder des éléments de preuve susceptibles de réhabiliter la mémoire de Wilbert Coffin, de grâce manifestez-vous au plus tôt.
USEFULNESS AND FUTURE OF MY BLOG

To those who question the usefulness of my blog and who worry about its future, I remind you that on the 25th of October 2006, a motion was passed by the Bloc québécois at the Standing Committee on Justice, requesting The Criminal Convictions Review Group (CCRG) to study whether there are grounds to overturn Coffin's 1954 conviction. This motion was adopted by the Canadian Parliament on the 6th of February 2007 and reads as follows:
« Whereas many observers, among whom the ex-newspaperman and senator Jacques Hébert, have revealed the irregularities surrounding the indictment, conviction and execution of Wilbert Coffin.
Whereas the sister of Wilbert Coffin, Mary Coffin, and the son of Coffin, Jimmy Coffin, wish that the formal judiciary process be initiated under Part XXI.1 of the Criminal Code, it is moved :
That, in accordance with section 108 (2) of the By-law, the Standing Committee on Justice and Human Rights recommend to the Government to act with diligence and celerity in the affair of the late Wilbert Coffin and that report be made to the House of the adoption of this motion in the shortest time possible.

THE ASSOCIATION IN DEFENCE OF THE WRONGLY CONVICTED (AIDWYC) HAS ALREADY MADE A PRELIMINARY REPORT
Let me remind you the remarks made by the member for Windsor-Tecumseh, Joe Comartin of the New Democratic Party, intervening in the Commons debates, on the 5th of February 2007. He affirmed what follows:
« There are all kinds of very solid allegations of partisan political interference in Québec at the time, at levels as high as the Premier and the Attorney General. The conduct of the Attorney in this affair is certainly suspect, according to what the Association in Defence of the Wrongly Convicted has told us. The role played by the counsel for the defence and the way he was brought into this trial make one flinch. »
You will notice that this Association has already made known its opinion in 2007. Why does it take so much time to make known its final report?
I am also awaiting the report of the Criminal Convictions Review Group (CCRG). Its investigation could call for three possibilities:
a) to dismiss the application,
b) to refer the case to a Court of Appeal,
c) or to order that a new trial be held.
If the CCRG reaches the conclusion that this affair should be dropped, you are right, my blog will no longer be needed. If, on the contrary, the case is referred to a Court of Appeal, my blog will still be very useful for many months and even for several years to come. The Government and I, however, do not have the same definitions of the words “diligence and celerity” and “in the shortest possible time.”

GOAL ACHIEVED
I will have achieved the goal that I had set for myself in writing my book L’affaire Coffin : une supercherie? (The Coffin Affair: A Hoax?) and in setting up this blog. I wanted to make accessible to the public all the available information on this affair. In so doing, the public will be in a position to judge by itself whatever the CCRG will propose to the Canadian Parliament or the judgment of a Court of Appeal or the sentence passed by a criminal court in the event a new trial is ordered. As you may realize, my blog may live many more years yet.
When I began looking into the Coffin affair, I was convinced that it was a miscarriage of justice. Like many Canadians, I had read Jacques Hébert’s books.
However, I would be very happy to hear that Wilbert Coffin’s name is cleared. Unfortunately, after having studied more than 20 000 pages of documents in the course of the past three years, I have not found anything that would warrant a glimpse of hope. And it is for this reason that I urge the Government to put an end, as early as possible, to the sufferings of the Coffin family. If someone out there has an element of evidence that could rehabilitate Wilbert Coffin’s memory, please come forward right away.

Me Fortin,

Dans le cadre du mandat volontairement limité dont vous vous faites le vulgarisateur, cadre englobant exclusivement les résultats de la Commission Brossard, même s'il compte plus de deux mille pages, que peut-il émergé de nouveau, de palpitant,d'intéressant ?
Rien ! Tout est connu, immuable ,définitif en un mot .

Alors , pourquoi ce blog ?
votre livre aurait suffi,non ?

De toute facon, votre blog deviendra un monologue, vous ne répondez aux questions de vos intervenants qu'en fonction du contenu du Rapport, sans jamais en sortir .Alors, quel intérêt à vous lire ?

Avec mon livre et ce blogue, je le répète, le public peut prendre connaissance de ce qui s’est passé devant le jury de Percé et la Commission Brossard. Je ne prétends rien de plus. Je n’ai aucune compétence pour faire une enquête judiciaire. Quoi que vous en pensiez, le public a maintenant autre chose à lire que les livres de Jacques Hébert pour se faire une idée de l’affaire Coffin. Et ne comptez pas sur moi pour vous inventer quelque chose de nouveau, de palpitant et d’intéressant. Attendez plutôt ce qui est à venir.

Le CRCC a reçu le mandat de voir s’il y avait des motifs susceptibles de permettre de renverser la condamnation de Wilbert Coffin en 1954. Le CRCC formulera la recommandation suivante :
Rejeter la requête de la famille Coffin .
le massacre a assez duré. Le malheur de cette pauvre famille a déjà été assez exploité par tous les rapaces du crayon et du film.
C'est donc la fin de votre blog.

yourself, mr. Fortin, and Mr. Stoddard sit each on the different side of the fence. each with your own good reasons. you sir are bringing to us the Brossard report on coffin case,on the side of our so called law. although I do enjoy reading your blog.at least we get to read what was said in brossard report. while Mr. Stoddard is looking at information that was presented at the trial of coffin in Gaspe, where this all began,also of what the Gaspe people had to say at cofffin's trial.It is true mr. fortin, the triple murder was never investigated in a proper way, the police did the best they could in 1953, they were untrained to investigate a triple murder..to be honest, they could not yet do it if it were to happen today. This murder took place over 50 years ago, most all involved are now laid to rest. there are people out there who have never set foot on the Gaspe coast, yet they will make comments about the case. They know nothing. there are still a few left in the Gaspe who was there at the coffin trial, who knew coffin .beleive it or not, they all think he was framed, yet none will speak out. they still speak in a whisper about coffins trail, what or whom are they so afraid of? I do beleive stoddard should not have written on Billy Baker and family, this had no bearing what so ever on coffin case or murder of the hunters.

Thanks for saying that you enjoy reading my blog. Over these past 50 years or so, I am the first one having requested access to the police file. Why was it not done before? Reading the Court and Commission archives appear to me to be the first thing to do. I have much respect for the jury and for the 214 witnesses who accomplished their duties in deposing before the Brossard Commission. I shall not carry a police investigation. It is beyond my competence. I shall not collect gossips because it is not the purpose of this blog. I was born in the Gaspé peninsula. I return every year and I am well aware of what is being said out there by a few. But when they were invited to testify before the Brossard Commission, they did not come forward. Why?

You guys are there asking each other ' What are those stupids afraid of ?
Let me remember you that there where three dead bodies at first , no body knows killed by whom, nor why ;then there was Wilbert Coffin keeping his mouth shut right to the gallows, then there was Billy Baker ,sudddenly gone ,some say heart attack, some say suicide,some say shot down.
Then there where fires , billy Baker hotel , Benny White hotel; then there where the mines company guys ,there was big money at stake and these guys spoke loud
So, when you have all those things happening in a short period of time , you keep it shut, you don't want to be the next people will ask about ' What's that he was talking about
these dead americans ?

Mr. Fortin, you are so right in asking."why did they not come forward" They have had 56 years to do so. stupids, hell no. coward if a far better name. Bakes Hotel burned at least 15 years after coffin was hanged. Billy Bakers death,what was it, about a week after coffin's hanging?all i can say is, hell you are all running out of excuses. 56 years has passed, no one left to be afraid of.

Ash inn is still standing, thats where Billy baker lived. does anyone remember the bar there? the wall and athe galss on the walls? there was old moey on the wall under the glass. lots of american money?

I am wondering does anyone remember where the forest gate in douglastown was? I know there was a road going up in the woods, i beleive it was called Gregrick or gregerys road. there was a house right beside the road,belonging to a gregric or gregery White. this house was right beside the st johns river bridge in douglastown, and just across the bridge was another woods road, this is where the douglastown forest gate was located.I did hear there were people that went through that gate, and it was never went on record?? up the woods road called gregric, or gregreys road there was a small farm belonging to a patterson, who i beleive,in the late 50's sold it,I guess there was gravel on that land, because it was turned into a gravel pit. I beleive anyone knowing the woods could have gotten to murdochville via any of those woods roads. anyone remember?

thanks for this site mr. Fortin.to commenter .Have no fear sir, all whom you fear i assume are gone now. I can see by your wording sir,that you are from the Gaspe. right? when you say "told or showed from someone from HERE, From the Gaspe"...you gave yourself away sir. for this reason i beleive you are from The Gaspe. there were many roads that could lead one into the camps where hunters were found. but you already know this sir, right? the trouble is, noone making comments on stoddard, or fortins blogs even know where Gaspe is, not to mention Murdochville. There was a house on patterson land,the land they turnrd into a gravel pit, the house was sold to a walsh from douglastown i beleive. I know this Gregrik or Gregery white was a very heavy drinker. There are a lot who know all this about roads and such but not many with the guts to tell it...later..

at the end of york center, if you continue on up into the woods, there were also camps there. also there was william Mcdonalds camps in the douglastown aera. also, just a bit below the st Johns river bridge is a woods road to get to what is called " pudding stone" you could also get to murdocville from there.

commenter, a slight error, now we know how fast an error can happen. does any one remember where wilbert coffin's camp was? when you wrote, "we keep it shut" I beleive you. that is the way it was. what i am writing is not gossip, but facts. sir, how do you know what track i am on??

I just posted a map drawn up by Maurice Hébert. On your right hand side, use a magnifying glass and you will see a black spot. That's where Coffin's camp was. In my book, this map may be seen on page 370.

Justice Brossard had this to say about a few Gaspesians: “... this case was not the only one, as we have seen or will see, where a few Gaspesians showed little importance to the strict truth and how few consider the consequences of the inaccuracies committed thoughtlessly, even sometimes under oath; for an example, John Hackett (above) and Régis Quirion (hereafter). “ Brossard Report, Vol. 2, page 199.

To reach Coffin's camp, one had to go through a gate. Ross Baird was the gatekeeper.

En page 17 du livre de M.Alton Price , Tromper le Jury , celui-ci fait mention du voyage de chasse du père Lindsay et de cinq autres participants fait en 1952 à Gaspé, soit l'année précédente aux évênements .Thomas Miller guidait le groupe .
Au cours de la chasse, une mésentente, une dispute, est survenue entre Lindsay et trois des autres chasseurs , Emmett(Pabos) et ses deux fils .Ceux-ci conduisaient une Jeep ( encore la Jeep ).
Ceci fut peu étudié au Procès ni à la Commission Brossard .
Pouvez vous nous revenir avec cette partie du témoignage de Thomas Miller devant la Commission ou nous référer à une section de votre livre .Je crois qu'on a jamais réellement identifié ces trois Emmett et vous n'avez pas parlé de leur Jeep

Le mystère entourant le supposé décès de Mr Stodddard reste entier.

Selon moi, Me Fortin, l'ADWC ne s'est jamais remise et ne se remettra jamais de votre arrivée dans le décor. Elle faisait du millage sur les histoires abracadabrantes de Jacques Hébert, d'Alton Price et de quelques autres. Vous l'avez ramenée à la réalité.

Mr. Fortin, Just a question to ask where the information came from on the location of wilbert coffins camp? that he had to go through the woods gate to get to his camp? yes a Ross Baird worked the douglastown gate, along with others.

Je vous cite des extraits du témoignage de Thomas Miller devant la Commission Brossard. « …and there was a man and two sons and another man... I cannot remember their names.” Plus tôt dans son témoignage, Miller nous apprend que l’un d’eux est Bill Willard. Et il poursuit : « There was this man and his two sons and they left a little sooner than they figured on... I don’t know.. there was a bit of a disagreement or something… I just forget now. » Selon le témoignage de Miller, Lindsey, père, aurait fait un voyage de chasse en 1951, 1952 et 1953. Il n’aurait donc pas fait deux voyages en 1952. Il confirme le fait qu’il n’a pas été le guide de Lindsey en 1953. Au fait, Bert Palmer corrobore ce fait en déclarant que Lindsey n’avait pas retenu les services d’un guide en 1953. Pour pouvez lire le témoignage de Thomas Miller dans le Vol. 37Q aux pages 8841 et suivantes des transcriptions sténographiques de la Commission Brossard. Quant au témoignage de Miller devant le jury de Percé, revoyez la page 245 de mon livre. « La jeep » dont fait mention monsieur Price aurait été sur les lieux en 1952 et non en 1953 au moment de la tragédie. Je vous incite à lire le témoignage de Miller au complet. Il serait trop long pour moi de le reproduire ici.
Je pense que vous devriez vous adresser à monsieur Alton pour obtenir des précisions sur son écrit. Je peux vous donner ses coordonnées si vous le désirez.

As to the location of Coffin's camp, apart from the map already displayed, I gathered the information from testimonies before the Percé jury. For instance, the testimonies of Mr. and Mrs. Baird who were the gatekeepers at that time. I suggest you read my book. I report the ins and outs of the Coffin case before the jury.

Merci pour les précisions en référence avec Thomas Miller.
Votre livre ,page 241 cite Willard Campbell Sr. ''Je suis venu ( à Gaspé )avec Eugene
Lindsay en 1952.
Vous donnez pourtant ,en page 245 1951 comme l'année où Thomas Miller a été leur guide ???
Mais là n'est pas le problème .
La Défense,à l'enquête préliminaire et au Procès de 54
furent très faibles avec Thomas Miller , de même que la Commission Brossard 10 ans plus tard avec ce même individu .
Cet incident survenu en 52 lors de la partie de chasse , l'altercation assez sérieuse entre Lindsay et les Emmett et leur départ en furie dans leur Jeep me semble un élément sérieux à enquêter . Les meurtres sont survenus l'année suivante...
par des américains...en Jeep...

La poursuite voulait connaître les habitudes de chasse de Lindsey. C’est pour cette raison qu’elle a invité à la barre des témoins des personnes qui le connaissaient. C’est ce qui ressort du contexte. Vous dites : « Les meurtres sont survenus l’année suivante… par des Américains… en jeep… » Vous supposez que ce sont des Américains, en jeep, qui ont commis ces meurtres. Et c’est pour cette raison que « cette altercation », selon vous, aurait dû faire l’objet d’une enquête. Je sais qu’on a tenté de relier ce meurtre à la recherche de minerais de cuivre. J’ai reproduit sur ce blogue le chapitre 4 intitulé Les concessions minières et les dépenses de Coffin (Partie IV, Vol. 1). Cette question de même que celle des jeeps (Voyez le chapitre 5) ont été étudiées à fond par la Commission Brossard. Devant la Commission Brossard, on a demandé à Miller si, à sa connaissance, Lindsey était intéressé à la prospection minière. Miller a répondu non à cette question. Willard Campbell est aussi catégorique à cet égard : « Il n’a jamais été question pour Eugène de faire de la prospection. »
Vous devriez demander à Alton Price où il a obtenu ces renseignements. Il semble avoir fait une enquête. Quant à moi, je vous répète que je n’ai ni la compétence ni les moyens de faire une enquête policière. Je vous rapporte les faits tels qu’ils ont été présentés devant le jury de Percé et devant la Commission Brossard.

J'ai dit et le redirai que
OUI ! Cet altercation majeur
en 52 durant la partie de chasse,entre Lindsay et les Emmett,aurait dû être fortement questionnée par la Défense
lors de l'enquête préliminaire et durant le Procès .Il n'y a eu aucune question du coté de la Défense à ce sujet ni dans l'un ni dans l'autre.
Le fait était pourtant connu des policiers et des procureurs .
Il aurait été de toute évidence normal à tout avocat même incompétent de faire un rapprochement entre cet incident et la déclaration de Coffin au sujet de la présence de deux jeunes américains , amis ? ou connaissances ? des Lindsay et voyageant à bord d'un Jeep,
surtout qu'il y avait six témoins bien vivants en 1954 pour l'affirmer .Ce n'étaient pas six fantômes qui accompagnaient le guide Thomas Miller .

Qu’est-ce qui vous permet de dire que cette altercation a été majeure alors que le témoin Miller rapporte que : «there was a bit of a disagreement or something. »? Comment pouvez-vous affirmer que la police n’a pas fait enquête? Avez-vous pris connaissance du dossier de police? Toutes les enquêtes de police ne sont pas nécessairement mises en preuve. Elles peuvent ne pas être jugées pertinentes et leurs résultats ne sont pas communiqués pour ne pas impliquer des personnes qui n’ont rien à voir avec la présente cause criminelle. Enfin, qu'est-ce qui vous dit que cet avocat même incompétent n’a pas tenté de faire un rapprochement, comme vous le suggérez, entre cet incident et la déclaration de Coffin, etc. ? Je vous suggère encore une fois de poser ces questions à monsieur Alton Price. Il s’est intéressé à cet « incident ». Me Fortin,
J'ai essayé à plusieurs reprises d'entrer en communication avec M.Price,jamais réussi .Anyway,
ce qui me surprend le plus,c'est que cette dispute entre les six chasseurs américains était bel et bien connue de Thomas Miller durant toutes les procédures contre Coffin. Thomas Miller n'était pas un sourd et muet à ce que je sache , et tous ces gens de la petite communauté anglophone de Gaspé,intéressés à défendre Coffin , à ce qu'on dit ,
tous certains de son innocence .
devaient bien être au courant ,
en ayant discuté avec Thomas Miller . Pourquoi c'est pas sorti durant les Procès ?
Sinon , s'ils n'ont rien fait , qu'ils ne viennent pas brailler
dans les médias et devant la Haute Cour de Justice , que la Justice au Québec , c'est pourri !
Ils n'avaient qu'à s'ouvrir la gueule dans le bon temps.

Ce commenter a le même style d'écriture,la même facon désordonnée de poser des questions ou d'affirmer des propos sans queue ni tête que le célèbre Mr Stoddard . Trouvez pas ? Stoddard serait-il de retour en catimini ?
